Terms & Conditions

The following Terms and Conditions apply to all products and services provided by Brand Em Outfitters. All work is carried out by Brand Em Outfitters on the understanding that the client has agreed to these Terms and Conditions.

Payment of an invoice indicates acceptance of these Terms.

Standard Brand Em Products

Product Materials

Many Brand Em products are made from 100% cotton and natural fabrics.

With regular wear and exposure to sun, sweat, washing and weather conditions, natural fading or wear may occur over time. This is considered normal wear and is not a manufacturing defect.

Fit and Sizing

Cap sizing is designed to fit most customers, however slight variations in sizing, structure or fit may occur between production batches.

Product descriptions provide general sizing guidance only.

Care Instructions

Improper washing, drying or storage may affect the shape, colour or structure of the product. Brand Em Outfitters cannot be responsible for damage caused by incorrect care or excessive wear.

 

Custom Made Products

All custom products including caps, apparel, stubby coolers and merchandise made specifically for your business are manufactured to order.

Because these products are produced specifically for each customer, orders cannot be cancelled, refunded or altered once production has begun, except where required under Australian Consumer Law.

Turnaround Time


Turnaround times vary depending on the product ordered.

Custom Caps


Custom caps generally take 8 to 10 weeks from payment being received.

This includes:
• digital mockup stage
• sample production and approval
• bulk production
• delivery

Other Custom Products


For other custom items such as apparel, stubby coolers and merchandise, typical turnaround time is approximately 3 to 4 weeks from payment being received, depending on the product and production requirements.

All turnaround times are estimates and may vary depending on production schedules and shipping conditions.

Proofing and Colour Accuracy


Design proofs are provided as a guide only.

Colours displayed on screens may appear differently on fabric, mesh, neoprene or printed materials.

Brand Em Outfitters will match colours as closely as possible, however slight colour variation between digital artwork and the final product is normal.

Customers must carefully review all proofs including:
• spelling
• phone numbers
• logos
• colours
• placement

Once a design is approved and production begins, Brand Em Outfitters will not be responsible for errors that were approved by the client.

Production Approval Process


The production process generally follows these steps:
1. A digital mockup is provided
2. Once approved and payment is received, the order is sent to production
3. A sample may be produced and photos sent for approval for applicable products
4. Bulk production begins once the sample is approved

Customers are responsible for reviewing and approving all designs before production begins.

Sample Approval


When a sample is produced, photos will be sent to the customer for approval.

Customers have 7 days from the date the sample photos are sent to provide feedback or request changes.

If no response is received within 7 days, the sample may be automatically approved and production will proceed to avoid delays and loss of manufacturing queue placement.

Once bulk production has begun, changes cannot be made to the order.

Sample Cancellation and Refunds

Once payment has been received and a custom order has entered artwork preparation, factory setup, sample development or sample production, costs are incurred by Brand Em Outfitters regardless of whether the order proceeds to bulk production.

If a customer chooses to cancel their order after sample development or sample production has commenced, Brand Em Outfitters may retain a cancellation fee of $300 to cover artwork, setup, administration, factory and sampling costs already incurred.

Any remaining balance paid above the $300 cancellation fee will be refunded to the original payment method.

If a customer chooses not to proceed following receipt of sample photos, this cancellation fee will still apply if sample development or production has already commenced.

Once bulk production has commenced, orders cannot be cancelled and no refunds will be provided except where required under Australian Consumer Law.


Customer Supplied Artwork


By supplying text, images or other data to Brand Em Outfitters, the client confirms that they have permission to use these materials.

Brand Em Outfitters accepts no responsibility for copyright or trademark infringement relating to materials supplied by the client.

The client agrees to fully indemnify Brand Em Outfitters against any claims relating to copyright or trademark violations.

Copyright


Copyright of all design work created by Brand Em Outfitters remains the property of Brand Em Outfitters unless otherwise agreed in writing.

Brand Em Outfitters reserves the right to display completed artwork in portfolios, marketing material, or promotional content.

Refunds and Defects


Refunds, returns and defect claims are governed by our Refund Policy.

Acceptance of Terms


Approval of designs and payment of invoices confirms that the client accepts these Terms and Conditions in full.
